912 PLAYGROUND NY INC.

PARTY RESERVATION TERMS AND CONDITIONS & FACILITY POLICIES

Please review these Terms and Conditions carefully before completing your reservation. By checking the agreement box at checkout and submitting your deposit, you (the “Host” or “Client”) agree to be legally bound by these policies of 912 Playground NY Inc. (the “Company” or “Facility”).

1. RESERVATIONS, DEPOSIT & PAYMENT AUTHORIZATION

Deposit Requirement: A party reservation is officially confirmed only upon receipt of the required deposit. A 50% deposit of your total party package price is required at the time of booking to secure your date and time slot.

Remaining Balance: The remaining balance, including any prearranged add-ons or fees, must be paid in full upon arrival and before the event begins.

Card on File & Authorized Charges: A valid credit or debit card matching the cardholder’s government-issued photo ID must remain on file for all reservations. By completing your booking, you authorize 912 Playground NY Inc. to charge the card on file only for the following amounts, subject to the limitations below:

  • Additional children or adults exceeding your booked package allowance, at the applicable prices disclosed at booking or displayed at the Facility.
  • Day-of food, beverage, grip sock, or merchandise add-ons, at the prices approved at the time of purchase.
  • Late-departure or overtime fees as stated in Section 2.
  • Reasonable, documented costs of excessive cleaning or of repairing or replacing property damaged during the event. Upon request, the Company will provide an itemized explanation and reasonably available supporting documentation for such charges.
  • Any unpaid balance due under these Terms if you depart before settling your final invoice.

Attendance Adjustments: Package pricing is based on reserved facility capacity and staffing allocation rather than actual guest attendance. No refunds, credits, or price adjustments will be issued if fewer guests attend than included in your booked package.

2. PARTY TIME, SETUP & OVERTIME FEES

Included Duration: Your reserved time block includes all setup, celebration, and cleanup activities.

Punctuality: Events must begin and end strictly at the scheduled times. Late guest arrivals do not extend the reservation period.

End-of-Party Breakdown: The Client must clear the party area and collect all personal belongings by the scheduled end time. Facility staff will assist during the final 10–15 minutes of the reserved time with packing gifts and other items so the room can be disinfected for the next event.

Overtime Charge: The party room must be fully vacated by the scheduled end time. If it is not, the card on file will be charged a total of $100 for overtime of up to thirty (30) minutes or a total of $200 for overtime of more than thirty (30) minutes and up to sixty (60) minutes. These charges are alternative, noncumulative tiers. Overtime does not create or guarantee an extension, and any extension is subject to schedule availability and management approval because another booking may follow. No extension beyond sixty (60) minutes is permitted unless management separately approves it in writing and discloses any additional charge in advance. All guests must continue to comply with Facility rules during any approved extension.

3. GUEST COUNT & FACILITY CAPACITY

Headcount Accuracy: The Client must provide an accurate guest count at booking and notify management in advance of any expected additional guests.

Capacity & Additional Guests: Attendance is limited by room capacity and safety regulations. Guests exceeding the package allowance incur additional per-person fees.

Occupancy & Room Assignments: All attendees, including adults and children, must comply with Facility occupancy limits. Party rooms are assigned at management’s discretion based on the confirmed headcount and Facility availability.

4. LIABILITY WAIVERS & PARENTAL SUPERVISION

Mandatory Waivers: Acceptance of these reservation Terms does not replace the separate “912 Playground Participant Liability Waiver and Release.” A parent or legal guardian must complete that waiver for each participating child before the child may enter or use the play area.

Active Parental Supervision: Parents and legal guardians remain responsible for actively supervising their children at all times.

Role of Staff: Facility staff and party hosts facilitate event operations but do not provide individual childcare or babysitting services.

Compliance with Rules: All guests must follow posted safety rules and reasonable verbal instructions from Facility staff.

5. GRIP SOCKS, HYGIENE & PLAYGROUND SAFETY

Anti-Slip Sock Requirement: Approved anti-slip grip socks are strictly required for all children and adults entering designated play areas. Outdoor shoes must be removed prior to entry.

Equipment Use: Equipment must be used strictly according to posted age, height, and safety guidelines.

Conduct & Zero Tolerance: Running in restricted areas, rough play, pushing, and other unsafe behavior are prohibited. The Facility enforces a zero-tolerance policy for bullying, intoxication, smoking or vaping, and abusive language or conduct toward staff. A noncompliant guest may be required to leave without a refund of amounts paid for that guest.

Strollers & Restroom Facilities: Strollers must be parked in designated areas off the play floor. All diaper changes must take place exclusively at changing stations located inside restrooms.

6. FOOD, BEVERAGES & ALCOHOL POLICIES

Outside Food Restrictions: Outside food and beverages are prohibited unless expressly approved in advance by management or included in the booked package. Personal water bottles are permitted.

Designated Dining Areas: Approved food, drinks, and birthday cakes must remain in designated party rooms and be kept away from playground equipment.

Prohibited Items: Alcoholic beverages, glass bottles or containers, chewing gum, and outside heating or cooking appliances (e.g., slow cookers, hot plates, chafing dishes, and Sterno or other open flames) are prohibited on the premises.

7. DECORATIONS, VENDORS & PERSONAL PROPERTY

Decoration Approval: All custom decorations must be pre-approved by management and must be set up and taken down within your reserved party time.

Prohibited Décor and Items: Confetti, glitter, silly string, piñatas, confetti-filled balloons, slime, indoor bubbles, smoke or fog machines, and sparkler or trick candles are prohibited. Standard birthday candles are permitted.

Wall Adhesives: Nails, screws, staples, and damaging adhesives are prohibited. Only blue painter’s tape may be used on walls if pre-approved by staff.

Third-Party Vendors: Outside entertainers and vendors (e.g., face painters, character performers, and photographers) must be approved in advance, use nonstaining and entirely glitter-free materials, and complete load-in and load-out during the reserved time.

Personal Belongings: To the extent permitted by law, the Facility is not responsible for lost, stolen, or damaged personal property, except to the extent caused by the Company’s gross negligence or willful misconduct. All items must be removed at the end of the event.

8. PARTY ROOM USE & CLEANUP

Access Rights: Access to the party room is limited to the reserved time.

Room Care and Maintenance: The Client must maintain reasonable cleanliness and dispose of trash in the provided bins. Furniture and equipment may not be moved without staff approval.

Excessive Cleaning and Damage Charges: Excessive mess, property damage, or remediation resulting from prohibited items (e.g., glitter, confetti, or silly string) may result in charges to the card on file for the reasonable, documented costs of cleaning, repair, or replacement. Upon request, the Company will provide an itemized explanation and reasonably available supporting documentation.

9. CANCELLATION, REFUND & RESCHEDULING POLICIES

Refund Eligibility Timeline:

At Least 14 Calendar Days’ Notice: The 50% deposit is fully refundable if the Company receives the Client’s written cancellation notice at least fourteen (14) calendar days before the scheduled party start date and time.

Fewer Than 14 Calendar Days’ Notice: The 50% deposit is nonrefundable if the Company receives the Client’s written cancellation notice fewer than fourteen (14) calendar days before the scheduled party start date and time.

Rescheduling Terms: A rescheduling request received fewer than fourteen (14) calendar days before the scheduled party start date and time does not qualify for a refund. Subject to availability, the Company may permit the Client to move the party to a future date. Any administrative fee must be disclosed to and approved by the Client before the party is rescheduled.

10. DAMAGES, WAIVERS & LIABILITY LIMITATION

Property Damage: The Host is responsible for the reasonable, documented costs of repairing or replacing Facility property damaged by the Host or the Host’s guests through negligent, reckless, or intentional conduct, subject to the charge and documentation requirements in Section 1.

Waiver Notice: The Host must inform each participating child’s parent or legal guardian that the separate “912 Playground Participant Liability Waiver and Release” must be completed for that child before the child may enter or use the play area. Acceptance of these reservation Terms does not replace that waiver.

Limitation of Liability: To the fullest extent permitted by New York law, the Company’s aggregate liability for claims arising from the reservation will not exceed the amount the Client actually paid for the booking. This limitation does not apply to the Company’s gross negligence or willful misconduct or to liability that cannot lawfully be limited or excluded.

11. ILLNESS & SAFETY RESTRICTIONS

Contagious Illness: A guest displaying symptoms of a contagious illness may not enter the Facility.

Operational Restrictions: The Company may restrict access to specific equipment or areas when reasonably necessary to maintain safety or hygiene standards.

12. REAL-TIME RESOLUTION & ELECTRONIC ACKNOWLEDGMENT

Real-Time Issue Resolution: The Client should promptly report any operational concern regarding party room conditions, food, decorations, or host service to management during the event so the Facility has a reasonable opportunity to address it. A failure to report an issue during the event may be considered when evaluating a later request for a refund or credit, but it does not waive any right that cannot lawfully be waived or prohibit a valid payment dispute.

Binding Electronic Agreement: By completing the online booking, you confirm that you are at least 18 years old and electronically accept these Terms and Conditions.

13. FACILITY CLOSURE AND EVENTS BEYOND CONTROL

Facility Closure and Events Beyond the Company’s Control: If the Facility cannot host the event because of severe weather, utility failure, government order, unsafe Facility conditions, or another event beyond the Company’s reasonable control, the Client may choose either to reschedule to an available date or to receive a refund of amounts paid for services not provided. The Company is not responsible for incidental or third-party expenses, including costs for decorations, entertainment, catering, or transportation.
